Terms of Service

The agreement between you and Pocket Adviser when you use our apps and website.

1. About these terms

These terms are the agreement between you and Pocket Adviser Pty Ltd (ABN 19 674 663 917) (Pocket Adviser, we, us, our). They apply when you use the Pocket Adviser mobile and web apps, our website at pocketadviser.com.au, and anything else we provide (together, the Service).

By creating an account or using the Service, you agree to these terms. If you don't agree, please don't use the Service.

Some other documents also apply and form part of your agreement with us:

  • our Financial Services Guide (FSG), which explains the advice service, how we're paid and how to complain;
  • any Statement of Advice (SOA) or Record of Advice (ROA) we give you, which sets out your personal advice and its scope; and
  • our , which explains how we handle your information.

If these terms conflict with your FSG or SOA, the FSG or SOA applies.

2. Who we are

Pocket Adviser is a platform that helps Australians make better financial decisions. Part of that involves providing personal financial advice through our web and mobile apps. We also offer tools you can use on your own, such as financial account aggregation, budgeting, and education.

Pocket Adviser does not hold an Australian financial services licence and is not an authorised representative of a licensee. We personal financial advice under ASIC's Enhanced Regulatory Sandbox (ERS) exemption, which lets new financial services be tested for up to 24 months without a licence.

Our exemption allows to provide personal advice and general advice in:

  • a deposit-taking facility made available by an ADI in the course of its banking business, other than a Retirement Savings Account (RSA), and
  • a security included in an official list of a prescribed Australian financial market.

We are a member of the Australian Financial Complaints Authority (AFCA), membership number 125674.

You can learn more about the sandbox on .

3. Eligibility and your account

To use Pocket Adviser you must:

  • be 18 or over;
  • live in Australia; and
  • be using the Service for yourself, not on behalf of someone else or a business.

You can only have one account. Please give us accurate details when you sign up and keep them up to date.

You are responsible for keeping your login details private and for anything done through your account. If you think someone else has accessed it, tell us straight away at .

4. What Pocket Adviser does

Pocket Adviser helps you make better financial decisions. The Service includes:

  • Setting of realistic financial goals based on your circumstances;
  • Personal advice in relation to investment in ASX-listed exchange traded funds (ETFs) and deposit-taking facilities with ADIs such as a savings account or term deposit;
  • Financial account aggregation and budgeting tools;
  • an AI chat assistant that explains things in plain English.

General information vs personal advice. Personal advice is the recommendation you receive after completing the advice process in Pocket Adviser's web or mobile app. Everything else, including on our website, blog, social media, AI chat, and other in-app content, is general information only and doesn't consider your objectives, financial situation or needs.

What we don't do. We don't hold your money, buy or sell investments for you, or have access to move money in your accounts. If you decide to act on our advice, you do that yourself through your own broker or bank.

5. Personal advice

How it works. Advice is generated by Pocket Adviser's proprietary algorithm, using the information you share with us. Generative AI is not used to generate advice.

It's limited in scope. Our advice only covers investment in ASX-listed ETFs and deposit-taking facilities with ADIs such as a savings account or term deposit. We cannot give advice on topics outside this scope, such superannuation, debt, insurance, tax or estate planning. Your SOA explains exactly what the advice covers and what it doesn't. Please read it carefully before acting on our advice. If you need advice on a topic outside this scope, talk to a licensed financial adviser.

It depends on what you tell us. Your advice is only as good as the information you give us. Please answer honestly and completely, and update your details if your situation changes. If information is wrong or missing, your advice may not suit you.

We may not be able to advise you. If our advice wouldn't be in your best interests, or what you need is outside what we cover, we'll tell you and recommend you contact a licensed financial adviser instead.

It's your decision. You choose whether to follow our advice. Investing involves risk: the value of investments can go up and down. We can't guarantee returns or that you'll reach your goals by acting on our advice. We can only recommend what we believe is in your best interests at the time.

6. Connecting your broker or bank

You can choose to connect your accounts in the Pocket Adviser web or mobile app. Connecting third party accounts is optional.

Broker accounts (SnapTrade). We use SnapTrade (operated by Passiv Inc.) to connect to your brokerage or investment account. You log in to your broker through SnapTrade, and we never see or store your broker password. The connection is read-only: we can see your holdings and account details, but we can't place trades, move money or change anything in your account.

Bank accounts (Open Banking). We use Fiskil to connect to your bank through the Consumer Data Right. You'll be asked for your consent before we receive any bank data, and you can withdraw it at any time.

Their terms apply too. When you connect an account, you're also dealing with SnapTrade or Fiskil, and their own terms and privacy policies apply to what they do. By connecting a broker account, you agree to and authorise SnapTrade to access your account on your behalf. Your broker's and bank's own terms continue to apply to your accounts.

Accuracy and availability. Connected data comes from your broker or bank. It may be delayed, incomplete or occasionally wrong, and a connection may stop working if your provider changes something. Please check important details with your provider directly. We're not responsible for the services of SnapTrade, Fiskil, your broker or your bank.

Disconnecting. You can disconnect an account at any time in the app. We'll stop retrieving data from it.

7. AI chat

Pocket Adviser's AI chat assistant uses large language models (LLMs) made available by third parties to explain money topics and your advice in plain English. It does not give personal advice. Your personal advice comes only from our advice process and is set out in your SOA or ROA.

AI can get things wrong. Responses may be inaccurate, incomplete or out of date, so don't rely on them alone for financial decisions. If the chat assistant says something different from your SOA or ROA, your SOA or ROA is correct.

Please don't use the chat to try to get it to produce harmful, unlawful or misleading content.

8. Fees and subscriptions

Pocket Adviser is currently free. We don't collect any payment details.

We plan to offer Pocket Adviser as a monthly subscription in future. Before we do, we'll give you at least 30 days' notice and tell you the price and what's included. We'll never charge you unless you've explicitly agreed to pay.

We don't receive commissions or other payments from product issuers or brokers for the advice we give you.

9. Using Pocket Adviser properly

Please use the Service fairly and lawfully. You must not:

  • give false information or pretend to be someone else;
  • connect accounts that aren't yours, or use the Service for someone else;
  • try to access other people's accounts or data, or parts of the Service you're not meant to;
  • copy, scrape, reverse engineer or resell the Service, our algorithm or its outputs;
  • interfere with the Service, including through bots, malware or excessive automated requests; or
  • use the Service for anything illegal, harmful or misleading.

10. Intellectual property

We own the Service, including our algorithm, software, content, name and logo. We give you a personal, non-transferable right to use the Service for your own purposes while you have an account.

You own the information you put into Pocket Adviser. You give us permission to use it to provide the Service to you, as described in our .

Your SOA and ROA are yours to keep and share with people you trust, such as a family member or another adviser.

11. Privacy

We take your privacy seriously. Our explains what information we collect, how we use and protect it, and your choices. We don't sell your personal information.

12. Your consumer rights and our responsibility

Your rights come first. Australian consumer law gives you guarantees that can't be excluded, including that our services will be provided with due care and skill. Nothing in these terms limits those rights, or our legal duties when giving you financial advice.

Where the law lets us limit our responsibility:

  • If we fail to meet a consumer guarantee for a service that isn't of a kind ordinarily used for personal or household purposes, our liability is limited to supplying the service again or paying the cost of having it supplied again.
  • We aren't responsible for loss caused by things outside our reasonable control, such as market movements, outages at third party providers (including SnapTrade, Fiskil, your broker or bank), or information you gave us that was wrong or incomplete.
  • We aren't responsible for loss from decisions you make based on general information rather than your SOA or ROA.

Availability. We work to keep the Service running smoothly, but it may sometimes be unavailable for maintenance, updates or reasons outside our control. We may change or remove features over time, and will tell you in advance if a change materially affects you.

13. Closing or suspending your account

You can close your account at any time in the app. Any paid subscription ends at the end of the current period.

We may suspend or close your account if you seriously or repeatedly break these terms, if we reasonably suspect fraud or misuse, or if the law or our regulators require it. We'll give you notice and a reason where we reasonably can.

We may also stop offering the Service, for example if our sandbox exemption ends. If that happens, we'll give you reasonable notice and refund any fees you've paid for time you can't use.

When your account closes, we handle your information as set out in our . We're legally required to keep records of any advice we gave you for 7 years, and you can ask us for a copy during that time.

You cannot transfer your account to someone else.

14. Complaints

If you're unhappy with anything, please tell us first at or through our . We'll acknowledge your complaint within 1 business day and aim to resolve it within 30 days.

If we can't resolve it, or you're not happy with our response, you can contact the Australian Financial Complaints Authority (AFCA), a free and independent service:

Our AFCA membership number is 125674.

15. Changes and general terms

Changes to these terms. We may update these terms from time to time, for example when we add features or the law changes. We'll publish the latest version in the app and on our website, and give you at least 30 days' notice of any change that materially affects you. If you don't agree with a change, you can close your account before it applies.

Governing law. These terms are governed by the laws of Victoria, Australia.

If part of these terms doesn't apply. If any part of these terms is found to be invalid or unenforceable, the rest still applies.
